Terms of Service
The agreement between you and BTCFi.ai when you use this service.
Last updated
1. Who we are and what this is
BTCFi.ai (the “Service”) is a non-custodial Ordinals NFT marketplace aggregator operated by Octus GmbH, a Swiss limited liability company registered in Baar, Canton of Zug (CHE-454.761.214), part of the Uniside group — full company details are in our imprint. The Service compares listings across third-party Ordinals marketplaces and shows you where an item is available and at what total cost. It never holds, custodies, or signs on behalf of users.
These Terms form a binding agreement between you and the operator. By using the Service, you agree to them. If you do not agree, do not use the Service.
2. Eligibility
You may use the Service only if all of the following are true:
- You are at least 18 years old, or the age of majority where you live.
- You have the legal capacity to enter into a binding contract.
- Your use is not prohibited by the laws of your country of residence — see section 10 on sanctions.
3. Nature of the Service — non-custodial
The Service never custodies your bitcoin or your inscriptions. We hold no private keys, no seed phrases, and no signed transactions. Connecting a wallet grants us read access to your public address so we can display what you own — nothing more.
How a purchase works today. We aggregate listings and show you a price comparison. When you choose to buy, we send you to the marketplace holding that listing, and the purchase completes there, with that marketplace, under that marketplace’s own terms and privacy policy. BTCFi.ai does not build, co-sign, or broadcast your transaction, and never takes possession of your assets. In-app settlement is not enabled. If that changes, these Terms will be updated first.
4. Service availability
The Service is provided on an “as is” and “as available” basis. It may be unavailable due to maintenance, upgrades, or upstream marketplace outages, and it is subject to rate limits. We aim for high availability but do not warrant it, and this phase operates without an uptime SLA.
5. Your responsibilities
- Keep your own wallet and keys secure — we cannot recover them.
- Verify every transaction detail in your wallet and on the destination marketplace before you pay.
- Use the Service lawfully, and comply with sanctions, export controls, and tax reporting where they apply to you.
- Do not disrupt the Service through abusive automation, scraping, or attempts to circumvent rate limits.
6. Fees
| Fee | Amount | Charged by |
|---|---|---|
| Network (mining) fee | Variable, sat/vB at broadcast | Bitcoin protocol |
| Marketplace fee | Per the venue | The third-party marketplace |
| Creator royalty | Per the collection | Collection creator |
| BTCFi.ai aggregator fee | 0% — we charge nothing | Operator |
We charge you nothing today. The network fee goes to Bitcoin miners, and any marketplace fee or creator royalty is charged by the venue where your purchase completes. Any future fee takes effect only after 30 days’ notice and will be shown in the cost breakdown before you commit.
7. Risk disclosure
Trading Ordinals involves substantial risk. You acknowledge:
- Data accuracy and staleness. Listings, floor prices, and rarity scores come from third-party APIs and may be delayed or out of date. An item shown here may already be sold, repriced, or withdrawn. Always verify in the marketplace’s own interface before paying.
- Market risk. Ordinals prices are volatile and you may lose your entire investment.
- Counterparty risk. Your purchase completes with a third-party marketplace we do not control, which may suffer outages, API changes, or breaches.
- Mempool exposure. The public Bitcoin mempool exposes signed transactions to potential replacement attacks.
- Wallet security. If your wallet is compromised, your assets may be drained and we cannot recover them.
- Regulatory risk. Rules vary by jurisdiction and may change.
8. Intellectual property
The Service software is proprietary to the operator and is not currently source-available. Inscriptions on Bitcoin are owned and controlled by their on-chain holders — we merely route pricing information about them. The BTCFi.ai name and logo may not be used without written permission.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA.
In particular, we do not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that displayed prices, listings, and rarity scores are accurate at any given moment.
10. Sanctions and restricted jurisdictions
You may not use the Service if you are located in, or a resident of, a country subject to comprehensive Swiss, EU, US, or UN sanctions, or if you are a sanctioned individual or entity. We may block access from sanctioned jurisdictions without notice. That is a defensive control, not a representation that every jurisdiction is comprehensively monitored.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, and our total aggregate liability shall not exceed the total fees you have paid us in the twelve months preceding the claim. Because we charge no fee during this phase, that cap is currently zero. We are not liable for losses arising from third-party marketplaces, mempool conditions, or upstream API failures.
12. Indemnification
You agree to indemnify and hold harmless the operator and its officers, directors, and employees from any claim arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Service outside its intended purpose.
13. Termination
We may suspend or terminate access immediately if you breach these Terms, or for any reason with reasonable advance notice. Obligations that by their nature survive termination — indemnification and limitation of liability among them — continue to apply.
14. Governing law and disputes
These Terms are governed by Swiss law, excluding its conflict-of-laws provisions and the UN Convention on Contracts for the International Sale of Goods. Disputes shall be resolved by the cantonal courts of Zug, Switzerland. For consumers in the EU, mandatory consumer-protection rules of your country of residence apply where they grant you greater protection.
15. Miscellaneous
- These Terms together with the Privacy Policy form the entire agreement between us regarding the Service.
- If any provision is unenforceable, the rest remains in force.
- Failure to enforce a provision is not a waiver of the right to enforce it later.
- You may not assign these Terms without our written consent; we may assign them in a merger or sale of assets.
- Nothing here creates a partnership, joint venture, or agency relationship.
16. Changes
We may update these Terms. Material changes will be announced on the site and reflected in the “Last updated” date above. Where Swiss law permits, continued use after the effective date constitutes acceptance.
